User Agreement

1. TERMS AND DEFINITIONS USED IN THIS AGREEMENT
The terms listed below within this Agreement have the following meanings:
1.1. Website – the totality of all information (text and graphic) located on the internet at http://lugela.pro, owned by LLC «Anastasia».
1.2. Website Administration – employees of LLC «Anastasia» authorized to modify information on the Website.
1.3. Website User (hereinafter referred to as User) – a person using the Website of LLC «Anastasia».
1.4. Parties – LLC «Anastasia» and the Website User who have entered into this Agreement.
2. GENERAL PROVISIONS
2.1. This User Agreement (hereinafter referred to as the Agreement) applies to the Website of LLC «Anastasia», located on the internet at http://lugela.pro
2.2. The Website is the property of Limited Liability Company «Anastasia».
2.3. This Agreement governs the relationship between LLC «Anastasia» and the Website User.
2.4. LLC «Anastasia» reserves the right to change, add, or remove sections of this Agreement at any time without notifying the User.
2.5. Continued use of the Website by the User constitutes acceptance of the terms of the Agreement and any amendments made.
2.6. The User is personally responsible for checking this Agreement for any changes.
2.7. The Agreement comes into force from the moment the User expresses consent to its terms by starting to view the Website or completing the registration process. The User is considered to have accepted the terms of the Agreement in full, without any reservations or exceptions.
3. SUBJECT OF THE AGREEMENT
3.1. The subject of this Agreement is to provide the User with access to information and online services presented on the Website.
3.2. The Website provides the User with the following types of services:
• free access to information (text and graphic) with the right to view such information;
• access to search and navigation tools of the Website;
• providing the User with the ability to request prices, services, reviews, and other information (feedback);
• access to information about services provided, special promotions, bonuses, and discounts;
• service ordering.
3.3. All existing services on the Website and any subsequent modifications or new services fall under this Agreement.
3.4. Access to the Website is provided free of charge.
3.5. This Agreement is a public offer. By accessing the Website, the User agrees to the terms of the Agreement and is deemed to have joined this Agreement.
3.6. The use of materials and services of the Website is governed by the applicable laws.
4. RIGHTS AND OBLIGATIONS OF THE PARTIES
4.1. LLC «Anastasia» has the right to:
4.1.1. Change the rules of using the Website, as well as modify the content of the Website. Changes take effect upon publication of the new version of the Agreement on the Website.
4.1.2. Restrict access to the Website or parts thereof in case the User violates the terms of this Agreement.
4.2. The User has the right to:
4.2.1. Access the Website for informational and similar purposes, as well as to online services presented on the Website.
4.2.2. Ask any questions related to services presented on the Website and other information posted on the Website via the «Contacts» section.
4.2.3. Use the Website exclusively for the purposes and under the conditions provided by the Agreement and not prohibited by law.
4.3. The Website User undertakes to:
4.3.1. Observe the proprietary and non-proprietary rights of authors and other rights holders when using the Website.
4.3.2. Not undertake actions that may be considered as disrupting the normal operation of the Website.
4.3.3. Not distribute any confidential and legally protected information about individuals or legal entities using the Website.
4.3.4. Avoid any actions that might breach the confidentiality of legally protected information.
4.3.5. Not use the Website for distributing advertising information.
4.3.6. Not use the Website's services for the purposes of:
• Uploading content that is illegal, violates any rights of third parties; promotes violence, cruelty, hatred and/or discrimination based on race, nationality, gender, religion, social status; contains false information and/or insults towards specific persons, organizations, or authorities.
• Encouraging unlawful acts and assisting persons whose actions are aimed at violating applicable legal restrictions and prohibitions.
• Violating the rights of minors and/or causing them any harm.
• Posing as another person or a representative of an organization and/or community without appropriate rights, including the Website Administration.
• Misleading about the properties and characteristics of any service posted on the Website.
• Incorrectly comparing services and forming negative attitudes towards persons who use/do not use certain services, or condemning such persons.
4.4. The User is prohibited from:
4.4.1. Disrupting the proper functioning of the Website.
4.4.2. Circumventing the Website's navigation structure by any means to obtain or attempt to obtain any information, documents, or materials not specifically provided by the Website's services.
4.4.3. Unauthorized access to Website functions, any other systems or networks related to the Website, as well as to any services offered on the Website.
4.4.4. Violating the Website's security or authentication systems.
4.4.5. Tracking or attempting to track any information about any other Website User.
4.4.6. Using the Website for any purposes prohibited by law, as well as inciting any illegal activities or other activities violating the rights of LLC «Anastasia» or other persons.
5. USE OF THE WEBSITE
5.1. The Website may not be copied, published, reproduced, transmitted, or distributed in any way in whole or in part without prior written consent of LLC «Anastasia».
5.2. The Website is protected by copyright as well as other intellectual property rights and unfair competition laws.
5.3. Online orders on the Website do not require registration on the Website.
5.4. The User is personally responsible for maintaining the confidentiality of information, as well as for all activities carried out on behalf of the User.
5.5. This Agreement applies to all additional terms and conditions for services provided on the Website.
5.6. Information posted on the Website should not be interpreted as amending this Agreement.
5.7. The Website Administration has the right at any time without notifying the User to make changes to the list of services offered on the Website and to the prices applicable to the services provided.
5.8. The «Privacy Policy» document regulates and applies to the User's use of the Website.
6. LIABILITY
6.1. Any damages the User may suffer due to intentional or negligent violation of any provision of this Agreement, or due to unauthorized access to another User's communications, will not be compensated by LLC «Anastasia».
6.2. LLC «Anastasia» is not responsible for:
6.2.1. Delays or failures during a transaction caused by force majeure, as well as any malfunctions in telecommunications, computer, electrical, or other related systems.
6.2.2. Actions of transfer systems, banks, payment systems and delays related to their operation.
6.2.3. Improper functioning of the Website in case the User does not have the necessary technical means to use it, as well as any obligations to provide such means to users.
7. VIOLATION OF THE USER AGREEMENT
7.1. LLC «Anastasia» has the right to disclose any information collected about the Website User if disclosure is necessary in connection with investigation or complaint regarding improper use of the Website or to identify the User who may violate or interfere with the rights of LLC «Anastasia» or other Website Users.
7.2. LLC «Anastasia» may disclose any information about the User deemed necessary to comply with current laws, court decisions, enforce this Agreement, or protect User rights.
7.3. LLC «Anastasia» may disclose User information if required or permitted by applicable law.
7.4. LLC «Anastasia» may terminate the User's access to the Website without prior notice if the User violates this Agreement or other documents containing the terms of Website use, or in the event of Website termination or technical failure.
7.5. LLC «Anastasia» is not liable to the User or third parties for termination of access to the Website in case of violation by the User of any provision of this Agreement or other Website usage documents.
8. DISPUTE RESOLUTION
8.1. In case of any disagreements or disputes between the Parties to this Agreement, a mandatory condition before applying to court is to submit a claim (written proposal for voluntary dispute resolution).
8.2. The recipient of the claim must inform the claimant in writing within 30 calendar days from the date of receipt about the results of the claim consideration.
8.3. If the dispute cannot be resolved amicably, any Party has the right to apply to the court for protection of their rights as granted by law.
8.4. Failure to comply with this provision results in dismissal of any claim or basis for claim due to statute of limitations.
9. ADDITIONAL CONDITIONS
9.1. LLC «Anastasia» does not accept proposals from the User regarding amendments to this User Agreement.
9.2. User reviews and questions posted on the Website are not confidential and may be used by LLC «Anastasia» without restrictions.
